The following document (the “Terms”), contains information about the owner of the website (“We”, “Us” or “Our”), as well as the terms governing the use of this website: www.vengotrips.com (the “Site”). By using this site the user (“You”), agrees to these Terms and, for this reason, we ask you to read the content carefully beforehand. We reserve the right to make changes at any time without prior notice, so we recommend you check back regularly.

By using this Site, you agree to the processing of personal data provided and guarantee that this data is correct. Personal data will be processed in accordance with our Privacy Policy, which we ask you to read for further information about our data processing purposes and your rights regarding your data.

3. Making Reservation and Payment

1. To make a reservation, please contact us by phone or via email and provide us with your preferred trip date and the number of people in your group. Upon confirmation of availability, we will send you a detailed trip presentation and a standard invoice for payment through the bank or PayPal (the latter incurs a 4% service charge).
2. To secure your reservation, a non-refundable deposit of 30% of the total trip price is required, payable within 2 business days of receiving the invoice.
3. The remaining balance must be paid in full before or on the trip departure date. Failure to pay the balance by this deadline may result in the cancellation of your reservation, and the forfeiture of your deposit.
4. By making a reservation with us, you acknowledge that you have read and agreed to these terms and conditions.
5. Once the reservation has been made and payment has been processed, we will send you a confirmation of your booking by email, which will serve as proof of the transaction and voucher.
6. We reserve the right to change prices at any time prior to your reservation being confirmed.

4. Cancellation

We understand that unforeseeable circumstances may arise, and it may be necessary to cancel your trip reservation. Our cancellation policy is as follows:

a) If the trip is cancelled due to border closures related to COVID-19, a full refund will be provided.

b) If you need to cancel your trip for personal reasons, and you notify us at least 60 days before the trip departure date, you may cancel free of charge or transfer your deposit to another trip.

c) If you cancel your trip less than 60 days before the trip departure date, your deposit is non-refundable. However, if you find a replacement participant, you may transfer your deposit to them.

d) We reserve the right to cancel the trip at any time due to unforeseen circumstances, such as weather conditions or other factors beyond our control. In such cases, we will refund your deposit in full, but will not be liable for any other costs or expenses incurred by you (e.g. non-refundable, advance-purchase air tickets, visa fees, equipment, etc.).

5. Costs not included to the trip

International airfare, flights integral to the trip itinerary (except for specified trips); passports, visas, immunizations, insurance of any kind, medical costs, costs of hospitalization or evacuation from remote areas, alcoholic beverages (except where specified in the itinerary), laundry, excess baggage charges or other items of a personal nature; additional expenses arising from the delay or extension of a trip due to weather, political disputes, sickness, failure of transportation, or other causes beyond our reasonable control. Please check the section of the Site with details of the Itinerary, which may indicate further exclusions.

6. Insurance and Medical issues

We strongly recommend that you obtain a short-term travel insurance policy covering baggage, accident/life, and trip cancellation. As well as covering the trip itself, cancellation insurance reimburses you for non-refundable air and land costs should you have to cancel the trip due to reasons covered by the insurance policy (personal or family illness, etc.). Our trips are not very rigorous, but certain activities are physically demanding. We assume no liability regarding provision of medical care. You are urged to check their insurance cover to ensure it is adequate.

In general, you must be in good health to participate in the trip; it is important that persons with medical conditions make these known to us when booking the trip.

7. Dispute

a) In the event of any dispute arising between the parties in relation to the interpretation, performance or termination of this agreement, the parties shall use their best efforts to resolve the dispute amicably and in good faith through negotiations.

b) If the parties fail to resolve the dispute amicably within a reasonable time), either party may initiate legal proceedings in accordance with Spanish law. The parties agree that any dispute or claim arising out of or in connection with this agreement or its formation shall be governed by and construed in accordance with the Spanish law.

8. Industrial and Intellectual Property

Industrial and intellectual property rights of the products and services offered, together with the site contents, belong exclusively to us or to third parties who have authorized us to use them. You agree that these terms do not give you any industrial or intellectual rights over the site’s content (ours or third party), including texts, images, audiovisual material, icons, among others. In this regard, you may not copy, reproduce, distribute, resend, reuse, publish, display, modify, create derivative works, or any other usage, by any means or procedure, without the authorization of the owner.

9. Obligations and requirements

By using this site you agree to the following conditions:

• When you access the website you do so under your own responsibility.
• Access to the website does not signify that a commercial relationship has been initiated between you and us.
• Website content is for information purposes and should not be construed as legal or financial advice. Therefore we recommend that you seek qualified professional advice on these matters.
• You are prohibited from using the site for illegal or harmful purposes, or in any other way that could damage or block the website from functioning normally.
• We are not responsible for comments made by other users and we reserve the right to delete comments that are offensive or illegal.
